Judgment
Mr.Shrikant Babaso Padwale & Ors. : Petitioners V/s. The Joint Registrar, Co-operative Societies, Kolhapur Division, Kolhapur & Ors. : Respondents ... Ms Varsha Palav with Mr.Rupesh Nalawade and Mr.Sarang Aradhye for the petitioners. Ms P.V. Badadare for Mr.P.R.Arjunwadkar for respondent no.3. ... CORAM : S.RADHAKRISHNAN & S.A.BOBDE, JJ. December 13, 2004. P.C.:
Heard the learned counsel for the petitioners and learned counsel for respondent no.3.
The vires of section 101 of the Maharashtra Co-operative Societies Act, 1960 has already been upheld by this Court. Admittedly, in this matter the petitioners 2 had also failed to deposit 50% of the amount at the time of filing of the Revision Application. The Divisional Assistant Registrar, Co-operative Societies exercising the revisional powers had rightly rejected it as the petitioners had failed to comply with the provisions of sub-section (2A) of section 154 of the Maharashtra Co-operative Societies Act whereby the petitioners had to deposit 50% of the amount. Under these circumstances, we find no merit in this Petition.
