THE HON’BLE SRI JUSTICE V.V.S.RAO WRIT PETITION No.12764 of 2010 ORDER: The petitioner is a member of Gram Panchayat Yerukallu Village of Duttaluru Mandal in SPSR Nellore District. The District Collector by proceedings Rc.No.F1/7620/2009, dated 02.01.2010, sanctioned the work of providing metal road from Gundemadakala road to Erukollu S.C.Colony at an estimated cost of Rs.7,00,000/- and the work of providing metal road from Gundemadakala road to Erukollu New S.C.Colony at an estimated cost of Rs.2,00,000/-. It is also alleged that another work is also sanctioned at an estimated cost of issued Work Rs.28,50,000/-. The Executive Engineer Commencement Order (WCO) on 17.03.2010. The grievance of the petitioner is that though the WCO is issued, necessary marking was not given and work was not entrusted to the Work Executing Member, statedly, the petitioner herein. Therefore, a direction is sought to the respondents to give markings for the commencement of the work. National Rural Employment Guarantee Act, 2005, or the various Government Orders issued there under do not require the marking of a work when once the administrative sanction is accorded by the District Collector and WCO is issued by the Executive Engineer. The legal position is not disputed or denied. Further, after getting instructions, the Assistant Government Pleader submits that though initially the work could not be commenced immediately, three days ago work has been commenced. The same is recorded. The Writ Petition stands disposed of accordingly. ____________
