04.07.2008 Heard the counsel for the petitioner and the State.
The allegation is that under the self guarantee scheme work was required to be done by engaging labourers but in that place machines were used, as such, it is in violation of Section 25 of the National Rural Employment Guarantee Act, 2005. Counsel for the petitioner submits that in case of violation of Section 25 of the Act, only punishment is fine and not imprisonment. It has also been stated that allegation do not make out a case under Sections 409, 420 and 471 of the Indian Penal Code.
Considering the facts, the prayer for anticipatory bail on behalf of the petitioner, Ranjeet Thakur @ Ranjeet Kumar, is allowed. He is directed to be released on anticipatory bail, in case of his surrender before the Court concerned within four weeks from today, on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Nalanda P.S. Case No. 25 of 2008 to the satisfaction of the Chief Judicial Magistrate, Nalanda, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code. Cp:3/S.A.
