THE HON’BLE SRI JUSTICE V.V.S.RAO WRIT PETITION No.5486 of 2010 ORDER: The Sarpanch of Lakshmi Polavaram Village of Ravulapalem Mandal in East Godavari District, is the petitioner seeking a direction to respondent Nos.3 to 5 to implement the sanction orders of the second respondent, namely, District Collector, and execute the works under rural connectivity project envisaged under National Rural Employment Guarantee Act, 2005. This Court heard the learned Counsel for the petitioner and the learned Assistant Government Pleader for Panchayat Raj. There is no dispute that by proceedings dated 12.11.2009, 22.12.2009 and 24.02.2010, the first respondent sanctioned totally a sum of Rs.17,00,000/- for three works namely gravelling the road from Yetigattu to SC Society, gravelling the road from Ella Tatayya house to Dammu Govind house in SC, BC Colony, and gravelling the road from Z.P road to Surplusvier drain. There is also no dispute that the Gram Panchayat has taken necessary steps for execution of the works. At the time of hearing, the learned Assistant Government Pleader placed before this Court a copy of the letter bearing Rc.No.J1/2669/09, dated 06.03.2010, from the Chief Executive Officer of the third respondent to all Mandal Parishad Development Officers in East Godavari District giving certain instructions with regard to implementation of NREGS works under rural connectivity project. The same reads as under. As per the instructions of the Commissioner, PR & RD, Hyderabad all the Mandal Parishad Development officers are directed to form the teams immediately and obtain the following information from the Gram Panchayat relating to the works sanctioned under NREGS 2009-10 for ZPP/MPP Components as per the statement enclosed.
A resolution by the Gram Panchayat to execute the work and identify the work executing members.

Bank Account Number exclusively for the said work. The designated teams are directed to visit the Gram Panchayats concerned from 8th March 2010 onwards and they shall take the resolutions and the extract of Bank Accounts and handed over the same in person to the Executive Engineer, PR concerned before 5.00 pm on 10.3.2010 at any costs. In order to complete the above task with in the stipulated time frame, the officers engaged for this purpose may also be given an honorarium towards fuel cost in order to facilitate them to use a two wheeler for traveling to the allotted Gram Panchayats. The above item of work should be treated as most urgent. In view of the above instructions from the Chief Executive Officer of the Zilla Praja Parishad, Kakinada, to all the Mandal Parishad Development Officers it cannot be said that steps are not being taken promptly. Respondents already are taking steps to transfer the sanctioned funds to Panchayats for their respective works. Accordingly, this Writ Petition is disposed of recording the submission of the learned Assistant Government Pleader. There shall be no order as to costs. _______________
