Heard Sri S. Borthakur, learned counsel for the petition er and Smti. B. Goyal, learned Government Advocate, Assam. A two fold grievance has been raised in this PIL. The f irst is with regard to non-payment of un-employment allowance to the job card ho lders represented by the petitioner’s association. Such un-employment is claime d under the provisions of National Rural Employment Guarantee Act, 2005 and the scheme framed thereunder. In the order dated 17-08-2010, this Court had already ob served that the aggrieved persons should take up the matter of un-employment all owance with the Programme Officer under the Grievance Redressal Mechanism framed by the Government. It is submitted by Sri Borthakur, learned counsel for the p etitioner that pursuant to the said order, on 24-08-2010 an appeal has been file d giving details of the claim of un-employment allowance. In view of the above, the concerned authority before who m the appeal has been filed will now pass appropriate orders expeditiously in th e matter. The second grievance raised in the PIL is with regard to constitution of the State Employment Guarantee Council under Section 12 of the Act. It has been submitted by Sri Borthakur, learned counsel for the petitioner that the said Council has since been constituted. The aforesaid grievance, the refore, will not survive. In view of the above, there is no live issue for adjudic ation in this PIL. The PIL, therefore, stands accordingly closed.
