24-09-2012. Heard learned counsel for the petitioner and perused the order of the Appellate Authority dated 19.10.2011 as well as the order of the writ court. In the last paragraph of its order, the Appellate Authority has referred exclusively to the documents which were made available to it by the employment agency. The illegalities and irregularities noticed by the Appellate Authority and its findings in that regard, have rightly not been interfered with by the writ court. It is evident that from the list of applicants and even those who are found to have participated in the counselling that they included candidates with higher marks than the appellant who has been ultimately appointed on the post of Panchayat Patna High Court LPA No.1249 of 2012 (3) dt.24-09-2012 Teacher. In the facts of the case, we are not persuaded to interfere with the order under appeal. The appeal is accordingly dismissed. In the facts of the case, no useful purpose will be served by issuing notices in respect of the limitation petition filed in this appeal because we are not satisfied with the merits of the appeal.
