JUSTICE SHIVAJI PANDEY ORAL ORDER 2 01-11-2013 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. In this application, the petitioner seeks bail connection with Makhdumpur P.S. Case no. 302 of 2013 for the offences punishable under Sections 457, 380/34 of the Indian Penal Code. This Court has granted bail to one Dharmesh Manjhi in Cr.Misc. no. 45417 of 2013. The defense, that has been taken in that case, is the same defense taken in this case. Having regard to the facts and circumstances, the petitioner is directed to be enlarged on bail on furnishing bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jehanabad, in Makhdumpur P.S. Case no. 302 of 2013, subject to the conditions that the petitioner shall remain present before the 2 court below on each and every date and cooperate with the proceeding. In the event of non-cooperation and failure to attend on two consecutive dates the court below will be at liberty to pass any order including cancellation of bail. A.Ahmad/- (Shivaji Pandey, J)
