(Oral) The petitioner has challenged the order dated 10-04-2008 whereby the representation of the petitioner for promotion to the post of Additional Director has been rejected. In the impugned order, the respondents have specifically and categorically referred to the Government policy as was existing prior to 2002, wherein the various posts equivalent in status including the post of Industrial Advisor are being filled up by promotion and were considered to be equivalent to the Additional Director. However, in the year 2002, the State Government formulated a new policy to reduce the number of promotions taking into consideration the Punjab Civil Services Rules. It has been indicated in the impugned order that presently there are two posts of Additional Directors one Sh. Vijay Sharma is working on deputation as Director, North India Institute of Fashion Technology, Mohali and one Sh. R.D. Sehgal is working as Additional Director in the Directorate of Industries & CWP No.3925 of 2009 Commerce. -2- In view of the availability of the two posts in the rank of Additional Director, the claim of the petitioner has been rejected. The learned counsel has argued that these persons who were holding the posts were not eligible. However, their promotion etc. are not under challenge. He further argued that a person junior to the petitioner has given current duty charge on the post of Industrial Advisor and that order is also not under challenge in this petition. Hence, no relief can be granted to the petitioner in the present petition. Dismissed. 10-3-2009 (PERMOD KOHLI) JUDGE
