The petitioner is the mother of late employee, who was serving as Havldar in the Army. She has filed this writ petition to pray for release of 25% of amount out of benefit of Army Group Insurance Death payment of her son, who has died. Concededly, the disbursement of the benefit of Insurance Fund would be regulated by the Group Insurance Scheme and as per the nomination done by the late employee. The petitioner stakes the claim of 25% of the amount on the ground that the wife of her son, who was entitled and eligible to get these benefits has given an affidavit in this regard. Wife has not been impleaded as party. It cannot be ascertained, therefore, whether any such affidavit relied upon by the petitioner, was ever filed or not. Still, if the petitioner, so advised, may approach the Civil Civil Writ Petition No. 16037 of 2009 -2- Court to make a claim for release of 25% of the amount. It would not be appropriate to go into this aspect. The petitioner is relegated to the remedy of filing the civil suit. The writ petition is, accordingly, disposed of.
