Judgment
Counter affidavit filed by the learned counsel for the respondent nos. 3 and 4 is taken on record.
Heard learned counsel for the applicant, learned A.G.A. for the State and learned counsel appearing for respondent nos. 3 and 4.
This application has been filed for quashing the charge sheet dated 12.08.2025 as well as cognizance order dated 20.09.2025 passed in Case No. 1444 of 2025, (State Vs. Arvind Kumar) arising out of F.I.R. No. 946 of 2022, under Section 135 of Indian Electricity Act (Amended), 2003, P.S. Anti Power Theft, District Sitapur.
After arguing the matter up to some length, learned counsel for the applicant submits that he does not want to press this application on merit and he confines his prayer only to the extent that applicant may be permitted to move discharge application through counsel and suitable directions may be issued for expeditious disposal of the same.
Learned A.G.A. as well as learned counsel for respondent nos. 3 and 4 have no objection in grant of aforesaid prayer.
In view of above, it is provided that applicant may move his 2 A482 No. 9582 of 2025 discharge application through counsel within three weeks from today and, in case, any such application is filed, the same shall be heard and decided expeditiously after hearing the parties in accordance with law, by means of a reasoned and speaking order.
For a period of six weeks or till the decision on the discharge application, whichever is earlier, no coercive steps shall be taken against the applicant in the aforesaid case.
