Grievance of the Petitioner in this writ petition is with regard to inaction of the Regional Transport Officer, Koraput in taking a decision on his application for grant of temporary permit.
It is submitted by learned counsel that the Petitioner has purchased a brand new vehicle bearing registration No.OD-10- W-2215 (Bus) and has applied for temporary permit on the route Jeypore-Damanjodi via Koraput, Similiguda and back. His application registered bearing No. APPN10/00055/2023. Although the application has been filed since 16th November, 2023 (Annexure-4), the RTO, Koraput has not taken any decision on the same. Since his vehicle is lying idle, the Petitioner finding no other alternative, has approached this Court. Mr. Behera, learned Standing Counsel for Transport Department submits that the application for temporary permit, stated to be pending, shall be considered in accordance with law expeditiously.
Considering the submissions made by learned counsel for the parties, this Court, without expressing any opinion on the merit of the case of the Petitioner, disposes of the writ petition with a direction that on production of the certified copy of this order, the RTO, Koraput shall take a decision on the application of the Petitioner for grant of temporary permit in respect of his aforesaid vehicle, as expeditiously as possible, preferably within a period of four weeks therefrom, if the same is still pending and communicate the decision thereof to the Petitioner forthwith.
