Heard learned counsel for the Petitioner and learned counsel appearing for the Opp. Parties.
Petitioner has filed the present writ petition inter alia with the following prayer:-
It is therefore prayed that this Hon'ble Court may graciously be pleased to admit this writ petition, call for records and after hearing the parties pleased to direct the OP No.3 to allow the petitioner to continue as such and take steps for regularizing the service of the petitioner as sweeper-cum-peon and regularize the post in behalf of the petitioner in the office of O.P. No.4 i.e. Bank of Baroda, Dungripalli branch in the Dist of Subarnapur. Keeping in view of the Judgement rendered by the Hon'ble Apex Court of India in case of Jaggo vs. Union of India & Ors., 2024 SCC online SC 3826 and Shripal & Anr. Vs. Nagar Nigam, Ghaziabad, 2025 SCC online SC 221 as well as Page 1 of 2. Dharam Singh & Ors. Vs. State of UP & Anr. (Civil Appeal No(s). 8588 of 2018. And pass any other order/orders, direction/directions as this Hon'ble Court may deem just and proper; And for which act of kindness, the petitioner shall as in duty bound ever pray.
However, taking into account the claim raised in the present Writ Petition, liberty is granted to the Petitioner to make a fresh representation before Opp. Party No. 2 by enclosing all the relevant documents and citations in support of her claim, if any, within a period of three (3) weeks hence.
It is observed that if such representation is filed within the aforesaid time period, Opp. Party No. 2 shall do well to take a lawful decision on the same within a period of three (3) months from the date of receipt of such representation. The order so passed by Opp. Party No. 2 be communicated to the Petitioner.
