S.S.SATHEESACHANDRAN, J. -----------------------------------------------Crl.M.C No.2508 OF 2012-------------------------------------------------------Dated this the 19th day of July, 2012ORDERPetitioner is the accused in Crime No.10/2010 of AdoorExcise Range. He was found in unauthorised possession of 2.4liters of Indian Made Foreign Liquor, is the gist of the accusation to prosecute him for the offence under Section 55(i) of the Kerala Abkari Act. After filing of the report and cognizance taken of the offence, the case is now pending in committal proceedings numbered as C.P No.147/2011 before the JudicialFirst Class Magistrate Court, Adoor. Limited prayer canvassed by the petitioner is for issue of a direction to the Magistrate to consider his application for bail on the date of his surrender. Having regard to the fact that the investigation is over and the case is pending in committal proceedings, I find that the following direction can be issued. In case the petitioner surrenders before the Magistratewithin a period of ten days and notice in advance on his application for bail is given to the Assistant Public Prosecutor, the Magistrate shall consider such application expeditiously, preferably, on the date of his surrender, if not prevented by any Crl.M.C No.2508/20122exceptional circumstances. I make it clear that the direction given as above shall not be construed as placing any impediment to the Magistrate in considering the application for bail on its merits, in accordance with law.
