It would not be necessary to issue notice to the respondent on this civil application as the respondent was not served in the second appeal when the second appeal was dismissed in default. For the reasons stated in the civil application the delay in filing the application for restoration of the second appeal is condoned. The Civil Application is allowed and disposed of. MCA ST.NO. 13284/2010. Heard the learned counsel for the applicant. It would not be necessary to issue notice to the respondent on this civil application as the respondent was not served in the second appeal when the second appeal was dismissed in default. For the reasons stated in the civil application the Second Appeal is restored to file subject to payment of costs of Rs.five hundred in the High Court Legal Services Sub-Committee, Nagpur. The M.C.A. is allowed in the aforesaid terms and disposed of. RR. JUDGE
