SMT. VASANTI A. NAIK, JJ. 08TH APRIL, 2008 Heard Mrs. S.S. Jachak, the learned Counsel appearing on behalf of the petitioner and Smt. B.H. Dangre, the learned Additional Government Pleader appearing on behalf of the respondents. The learned Counsel for the petitioner states that the petitioner has applied for permission to start 8th, 9th and 10th standards in New English School at Khangaon, District Yavatmal for the Academic Session 1999-2000. However, this date, there is no communication from the State Government about the rejection of the application. At the outset, we find that the petition is suffering from delay and laches and, therefore, we are not inclined to entertain the petition. However, the learned Additional Government Pleader states that if the application of the petitioner is already rejected, the order of rejection would be 2 communicated to the petitioner. It is made clear that the order of rejection would not create a new cause of action in favour of the petitioner to challenge the same after nine years since we have already observed in our order that the petition suffers from delay and laches. With these observations, the writ petition stands disposed of. JUDGE JUDGE *rrg.
