This revision case is directed against an order dated 14/02/2003 made in Crl.M.P.No.4108 of 2002 on the file of the Court of II Metropolitan Magistrate, Vijayawada, whereby the petition filed under Section 68 (2), (3) and (4) of Wakfs Act, 1995 for delivery of charge and possession of records, accounts and properties including cash was allowed. While this matter was admitted on 13/03/2003, this Court passed a conditional order, which reads as follows:
Pending further orders, there shall be interim stay of all pursuance of the order of the Court of II further proceedings Metropolitan Magistrate in Crl.M.P.No.4108 of 2002 dated 14/02/2003, subject to the following conditions: a) The Inspector Auditor, A.P.Wakf Board, Krishna District, shall verify as to how many books and registers were handed over to the petitioner herein when he assumed charge of question. the wakf b) He shall also verify as to how the said books and registers are taken over by the 1st and 2nd respondents. c) The balance, if any, shall be made available to the Auditor Inspection within one weeks from the date of the said verification.
Later on, the respondents approached this Court and filed a petition to vacate the said order. A learned Judge of this Court, after hearing the parties, by his order dated 28/11/2003 vacated the said interim order granted by this Court. In the light of the said vacation of the interim order as early as in the year 2003, in my considered opinion, this revision case must have become infructuous and the said records must have been handed over long back.
