This Court made the following: THE HON’BLE MR. JUSTICE SAMUDRALA GOVINDARAJULU WRIT PETITION No.3449, 3473, 3668, 3683 and 3961 of 2012
COMMON ORDER:-
The petitioners – Contractors in all these writ petitions are aggrieved by respective letters of the Executive Engineer by which the petitioners’ deposits i.e., FSD, EMD insurance etc. were forfeited and the petitioners were further requested to pay balance of amounts on the basis report of Regional Vigilance and Enforcement Department, on which the Government is stated to have issued instructions to effect recoveries of the alleged excess payments made to the respective petitioners in their contract works. Assistant Government Pleader for Irrigation & CAD is also heard. These writ petitions are squarely covered by judgment, dated 23.11.2011, passed by Division Bench of this Court in Writ Appeal No.1019 of
2011. The petitioners are entitled for similar relief in these writ petitions also.
Operative part
In the result, all these writ petitions are allowed quashing impugned letters, dated 20.07.2011, and
19.07.2011 of the 4th respondent for recovery of amounts after forfeiture of FSD, EMD and insurance deposits of the respective petitioners. At the same time, it is open to the respondents to arrive at excess payments if any made to the petitioners after following due process of law and after giving opportunity to the petitioners to represent their cases on that subject.
