SREENIVAS RAO CRIMINAL PETITION No. 795 of 2025 ORDE R: This Criminal petition is filed under Sectio n 52g of Bharatiya Nagarik Suraksha Sanhitha, 2023 (for short ,.BNSS,,) by the petitiorLer/accused seeking to quash the docket order, dated 24.12.20112 passed in crr.M.p.No.2gr0 of 2022 in crime No.20l of 2022 of p.S. Manedpally for return of petitioner Revolver Butt l\o. N.P.FG lgg50/2007,6_Rounds with license book was dismir; sed. 2' Heard Ms. A.Nagarani, learned counsel rearned counsel for petitioner and learned Assistant public prosecutor appeadng for the State and perused the record.
Learned c,ounsel for petitioner submits that petitioner filed an application vide crr.M.p.No.20l of 2022 before X Additional Chief Metropolitan Magistrate, Secunderabad, seeking return of Revolyer Butt No. N.P.FG lggi0/2007,6_Rounds with license book. The Court below, without properly considering the same, 2 dismissed the said application by its order dated 24'122022' Learned counsel for petitioner further submitted that in similar circumstances, this Court disposed of Crl.P.No'10765 of 2024 on
19.09.2024 directing the concemed Court to return the property by imposing proper conditions. Hence, petitioner in this criminal petition is also entitled to very same relief.
Learned Assistant Public Prosecutor for respondent-State has not disputed the same.
Having considered the rival submissions made by respective parties and after perusal of the material available on record, it reveals that petitioner filed an application 1n Crl.M.P.No.28l0 of 2022 for return of material and the same was dismissed by the Court below on 24'12'2022'
Taking into consideration the facts and circumstances of the case and also the order passed in Crl'P'No'10765 of 2024,the trial Court is directed to retum back the Revolver Butt No' N.P.FG 18850/2007, 6-Rounds with license book' to the petitioner herein by imposing appropriate conditions thereon' 3 7 Accordingly, this Criminal petition is disposed ol.
