SREENI VAS RAO CIUMI NAL PETITION No.795 of 2025 ORDER: This Cr.iminal petition is fited under Section 52g of Bharatiya Nap; arik Suraksha Sanhitha, 2023 (for short ,.BNSS,,) by the petitioner/accused seeking to quash the docket order, dated 24.12.2()22 passed in crl.M.p.No.2gl0 of 2022 in crime No.201 of 2022 of p.S. Marredpally for return of petitioner gun (1) one 12 Bore Sin_ele Barrel Shorr Gun having Bufr No.64g7l_ 66 (Shiva gun works), (2) one pouch consisting ol (05) Iive rounds was disrnissed. 2' Heard Nfs. A.Nagarani, learned counser lcarned counsel for petitioner and l,earned Assistant public prosecutor appearing for the State and perused the record.
Learned c,cunsel for petitioner submits that petitioner liled an application vtde Crl.M.p.No.20l of 2022 before X Additional Chief Metropolitan Magistrate, Secunderabad, seeking return of gun (1) one 12 Bore Singlc Barrel Shorl Gun having Butt ;l ,l 2 No.64871-66 (Shiva gun rvorks), (2) one pouch consisting of (05) live rounds. The Court below, without properly considering the same, dismissed the said application by its order dated
24.12.2022. Learned counsel for petitioner further submitted that in similar circumstances, this Court disposed of Crl.P.No.l0765 of 2024 on 19.09.2024 directing the concerned Court to return the properly by imposing proper conditions. Hence. petitioner in this criminal petition is also entitled to very same relief.
Learned Assistant Public Prosecutor for respondent-State has not disputed the same.
Having considered the rival submissions made by respective parties and after perusal of the material available on record, it reveals that petitioner filed an application 1n Crl.M.P.No.2810 of 2022 for return of material and the same was dismissed by the Court below on 24.12.2022.
Taking into consideration the facts and circumstances of the case and also the order passed in Crl.P.No.l0765 of 2024,the trial Court is directed to return back the gun (l) one 12 Bore 3 Single Barlel Short Gun having Butt No.64871-66 (Shiva gun works), (2) one pouch consisting of (05) live rounds,, to the petitioner herr-'in by imposing appropriate conditions thereon.
