Perused order dated 22nd June, 2012, wherefrom it appears that, in view of the office note dated 18th July, 2007, appellant was directed to take steps f or service of notice on respondent no. 3 within seven days. As none appeared for appellant and the respondent, registry was also directed to forthwith serve a c opy of the order on Mr D Choudhury, learned counsel for the appellant, and the m atter was directed to be listed today. There is an endorsement at page 3 of office note-sheet that copy of the order had been received on behalf of Mr D Choudhury on 27.6.2012. Steps are yet to be taken on respondent no. 3, as would be revealed from office note dated 21s t August, 2012. In view of above, the appeal is dismissed for non-prosecution.
