The appellant has filed the instant appeal under Section 19 (1) of the Family Court Act, 1984 against the impugned judgment & decree dated 03.01.2023 (Annexure A-1) passed in Civil Suit No. 523-A/2019 passed by the learned Family Court, Bilaspur, District- Bilaspur (C.G.), whereby the learned Family Court rejected the application under Section 13 (1) of Hindu Marriage Act of the appellant for decree of divorce. Therefore, the present appeal filed by the appellant. 2
During the pendency of appeal both the parties agreed for amicable settlement and vide order dated 29.07.2025 the matter was referred to Mediation Centre of this Court and both parties have settled their dispute before the Mediation Centre of this Court on 11.08.2025, wherein statements of both the parties got recorded and compromise was arrived at between the parties in terms of the settlement agreement dated 11.08.2025, which was duly signed by them.
Operative paras of settlement agreement dated 11.08.2025 are as under:- “ माननीय उ्ሴ न्यायालय के आदेश दिदनांक 29.07.2025 के परि(cid:19)पालन में यह ्ቚक(cid:19)ण FA(MAT) No. 71/2023 (Smt. Jamuna Patel Vs. Mahendra Kumar Patel) में मध्यस्थता हेतु ्ቚेदि(cid:29)त दिकया गया आज दिदनांक 11.08.2025 को मध्यस्थता ्ቚदिकया संप्ቐ दिकया। मध्यस्थता ्ቚदिकया के अनुरूप प्ቌका(cid:19)गण के मध्य एकल एवं संयु्ሹ स्ቔ मध्यस्थता के न््ቖ छ्ቈीसगढ़ उ्ሴ न्यायालय, दि/लासपु(cid:19) में दिदनांक 11.08.2025 को उभयप्ቌ के मध्य आयोजिजत दिकया गया। आज दिदनांक 11.08.2025 को उभयप्ቌ अंतितम दिनण3य की ቝኌस्थतित में पहु ँच चुके हैं औ(cid:19) उनके मध्य दिववाद स्वेच्छापूव3क पूण3 सहमतित के साथ सभी दिववादों प(cid:19) दिनपटा(cid:19)ा क(cid:19) एवं अपने आपसी वैचारि(cid:19)क मदभेद एवं दिववाद को त्याग क(cid:19) दिनम्नलिललिBत समझौता क(cid:19) स्वतं्ቔ रूप से अपना- अपना आगे का जीवन दिनवा3हन क(cid:19)ने हेतु सहमत है। उभयप्ቌ के /ीच दिनम्नलिललिBत शतE प(cid:19) समझौता दिकया जा (cid:19)हा है :-
1. यह दिक दोनो प्ቌका(cid:19) आपसी सहमतित के ्ቛा(cid:19)ा आपस में दिववाह दिवच्छेद के लिलए सहमत है।
2. यह दिक माननीय उ्ሴ न्यायालय के सम्ቌ ्ቚस्तुत आवेदन को अपीलाथG ्ቦीमती जमुना पटेल नहीं चलाना चाहती तथा उ्ቈ(cid:19)वादी ्ቦी महेन््ቖ कु मा(cid:19) पटेल भी इस ्ቚक(cid:19)ण को आगे नहीं चलाना चाहता।
3. यह दिक अपीलाथG उ्ቈ(cid:19)वादी से दिकसी भी ्ቚका(cid:19) का भ(cid:19)ण-पो(cid:29)ण, स्थाई जीवन दिनवा3ह (Permanent Alimony) के अतिLका(cid:19) को छोड़ (cid:19)ही है तथा भदिवष्य में दिकसी भी ्ቚका(cid:19) का भ(cid:19)ण- पो(cid:29)ण का दावा नहीं क(cid:19)ेगी।
यह दिक अपीलाथG जमुना पटेल माननीय छ०ग० उ्ሴ न्यायालय में लंदि/त दिववाह दिवच्छेद ्ቚक(cid:19)ण को वादिपस लेती हैं तथा उ्ቈ(cid:19)वादी के चल औ(cid:19) अचल संपलि्ቈ प(cid:19) दिकसी भी ्ቚका(cid:19) का भदिवष्य में दावा नहीं क(cid:19)ेगी।
यह दिक उप(cid:19)ो्ሹ शतE के आLा(cid:19) प(cid:19) दोनों प्ቌका(cid:19) दिववाह दिवच्छेद के लिलए सहमत हैं। उभयप्ቌ इस समझौता प्ቔ की शतE से सहमत हैं एवं पालन के लिलए कदिट/्ቍ हैं समझौता प्ቔ में दी गई शतE को उन्होंने अपनी स्वयं की स्वेच्छापूव3क सहमतित एवं दि/ना दिकसी द/ाव, भय एवं लालच से स्वीका(cid:19) दिकया गया है। उभयप्ቌ ने इस समझौता प्ቔ की 3 शतE को पढ़ने व समझने के प्ቐात अपनी स्वतं्ቔ सहमतित से प(cid:19)स्प(cid:19) एक- दूस(cid:19)े की उपቝኌस्थतित में हस्ता्ቌ(cid:19) क(cid:19) दिनष्पादिदत दिकया है। दि/लासपु(cid:19) (छ.ग.) दिदनांक 11.08.2025 ्ቚथम प्ቌ ………… ..Sd/-…………. दि्ቛतीय प्ቌ …… ...Sd/-…. ्ቦीमती जमुना पटेल D/o ्ቦी- मोती (cid:19)ाम पटेल Mob-[REDACTED] महेन््ቖ कु मा(cid:19) पटेल दिपता- ्ቦी कु ँ न(cid:19)ाम पटेल Mo. Learned counsel for the parties jointly submit that the aforesaid agreement has been arrived at between the parties without any pressure or coercion, out of their own free will, whereby they have amicable resolved the dispute before the Mediation Centre of this Court and therefore, the present appeal may be disposed of in terms of the aforesaid agreement dated 11.08.2025.

11.08.2025, the present appeal is disposed of in terms of the said agreement, the terms of the settlement agreement dated 11.08.2025, will form part of this judgment/decree. However, liberty is granted to the appellant to file an application under Section 13 (B) of Hindu Marriage Act, 1955 before the learned Family Court.
