Although, there is specific allegation against the petitioner that he along with two other accused committed rape on the complainant but submission on behalf of the petitioner is that petitioner being Chowkidar of Sikti Police Station got a Parwana to arrest the husband of the complainant and after that when the husband of the complainant was arrested by the petitioner and remanded to judicial custody, the complainant has brought this case against the petitioner and others. No doubt, the alleged occurrence took place in the year 1999 but submission on behalf of the petitioner is that the petitioner was not aware about the filing of the present complaint case. Considering the aforesaid facts and circumstances as Patna High Court Cr.Misc. No.11846 of 2012 (2) dt.26-03-2012 well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria in connection with Complaint Case No. 1297 (C) of 1999.
