JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 2 31-07-2012 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report but in course of investigation looted mobile has been recovered from conscious possession of the petitioner. The contention on behalf of the petitioner is that petitioner had purchased the said mobile from one Binod Sah of his locality and in course of investigation, when confessional statements of other accused were recorded, none of the accused has stated about the involvement of the petitioner in the alleged crime. It is also contended by him that petitioner does not have any criminal antecedent. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with Patna High Court Cr.Misc. No.27321 of 2012 (2) dt.31-07-2012 two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Patna in connection with Naubatpur P.S. Case No. 268 of 2011.
