JUSTICE JAYANANDAN SINGH ORAL ORDER 5 25-06-2013 In this case a dispute is being raised by the respondents with regard to title of the petitioner on the land in question claimed on the basis of hukumnama of the ex-landlord and rent receipts. Question of title cannot be decided in a writ proceeding. In the circumstances, this matter is transferred to the Land Tribunal in terms of section 9(2) of the Bihar Land Tribunal Act, 2009 as in terms of clause (c) of section 9 of the Act the Tribunal is vested with the powers of a civil court under the Code of Civil Procedure. Office to take steps accordingly. Patna High Court CWJC No.3248 of 2013 (5) dt.25-06-2013 On receipt of records, the Tribunal shall issue notice to the parties to appear before it fixing an early date. Till the first date of hearing of the matter by the Tribunal, interim order passed by this Court on 28.2.2013 shall continue. (Jayanandan Singh, J) Pradeep/-
