NATH ORAL ORDER 2 24-07-2012 Mr. Prabhat Ranjan Singh, the learned counsel appearing on behalf of the appellants submits that this appeal has been filed before this Court under misconception and in fact according to valuation being Rs. 45,100/- the appeal ought to have been filed before the District Judge. The learned counsel for the petitioner prays for return of the memo of appeal for presenting before the appropriate court. Although, the appellants have not mentioned valuation in the memo of appeal but from the impugned decree it appears that the valuation is only Rs. 45,100/-. In this view of the matter, this appeal is not maintainable before this Court and the prayer on behalf of the appellant is allowed for return of the memo of appeal for its presentation before the appropriate court. The appellants shall receive the memo of appeal within two weeks and thereafter present it before the appropriate court within a period of four weeks. Devendra/- (V. Nath, J)
