NATH ORAL ORDER 4 12-09-2012 This restoration application has been filed for restoration of C.R.No. 589/10 which has stood dismissed for want of prosecution by order dated 30th April, 2012. As the opposite party no.11 of the said revision application was present on 30.04.2012, learned counsel for the petitioners has submitted that the copy of the restoration application has been served upon the learned counsel who appeared for the opposite party no.11. It has been stated in the restoration application that the learned counsel for the petitioners, though was present in the Court on 30th April, 2012, but he suddenly took ill due to high blood pressure and left the Court and consequently could not appear when the revision application was called out resulting in its dismissal. In view of the statement made in the restoration application Patna High Court MJC No.2346 of 2012 (4) dt.12-09-2012 and after considering the submissions on behalf of the learned counsel for the petitioners, it appears that the sufficient cause has been assigned for non-appearance of the learned counsel for the petitioners on 30.04.2012 when the revision application was taken up for hearing on the point of admission. As such, the prayer for restoration is allowed and the C.R.No.589/10 is restored to its original file. Nitesh/- (V. Nath, J)
