23-12-2013 Learned counsel for the parties are present. The petitioner has questioned the order passed by the statutory authorities in exercise of powers vested under the provisions of Bihar Consolidation of Holdings and Prevention of Fragmentation Act, 1956. The subject matter is amenable to the jurisdiction of the Bihar Land Tribunal constituted under Section 4 of the Bihar Land Tribunal Act, 2009 (hereinafter referred to as ‘the Act’) and the rules framed thereunder. In view of the provisions of Sections 9 and 15 of the Act read with rule 5(6) of the Bihar Land Tribunal Rules, 2010, the Patna High Court CWJC No.10458 of 2007 (3) dt.23-12-2013 2 records of the writ proceedings stand transferred / remitted to the Bihar Land Tribunal for adjudication.
