01-04-2013 Heard Sri J.S.Arora, learned counsel, who was assisted by Sri Parmanand Kumar, learned counsel for the petitioner, learned A.C. to Standing Counsel No. 16 as well as Sri Subodh Kumar Jha, learned counsel, who has appeared on behalf of respondent no. 2 ‘series’. The present writ petition is in relation to a 2 Patna High Court CWJC No.8622 of 2002 (16) dt.01-04-2013 dispute under the Bihar Tenancy Act, 1885 (in short ‘B.T.Act’), particularly; under Section 48D of the B.T.Act. During the pendency of the present writ petition for adjudication of such dispute, an appropriate forum has already been created and functioning as ‘Land Tribunal’, constituted under the provisions of Bihar Land Tribunal Act, 2009. Accordingly, the Court is of the opinion that this matter can well be adjudicated by the Land Tribunal. In view of provision contained in Section 15 of the Bihar Land Tribunal Act, 2009, the Registry is directed to transmit the record to the Tribunal forthwith. (Rakesh Kumar, J.) Anay
