Heard learned Counsel for the petitioner, learned Standing Counsel for the State and Shri Ratnesh Chandra, learned Counsel for the Lucknow Development Authority. After hearing the parties, what comes out is that an order of sealing and demolition was passed against the petitioner under the U.P. Urban Planning and Development Act, 1973 (hereinafter referred to as 'the Act, 1973') against which the petitioner preferred an appeal which was dismissed on 20.01.2025, against which a revision has been filed under Section 41 of the Act, 1973 within time, as claimed, which is pending, as stated in Paragraph no. 29. During pendency of the revision, the opposite parties are proceeding to give effect to the order of demolition. In view of the aforesaid, we dispose of this petition with the observation / direction that if any revision has been filed which is pending and proof thereof is submitted by the petitioner before the opposite party no. 2, then the demolition exercise shall not be given effect till disposal of the revision. The revisional authority is directed to dispose of the revision within a period of two months, unless there is any legal impediment. Shri Shailesh Tiwari, learned Standing Counsel shall communicate our order to the revision authorities for compliance.
