Operative part

19.12.2000 under Section 68 of U.P. Co-operative Societies Act, 1965 imposing surcharge and recovery order, therefore, has been issued by him. Under Clause (g) of sub Section (1) of Section 98 of U.P.Co-operative Societies Act, it is appealable order. It is open for the petitioner to file an appeal where the full facts can be thrashed out in appeal. Therefore, the petitioner may be relegated to Co-operative Tribunal. Accordingly, petition is dismissed on the ground of alternative remedy. Appeal, if filed, shall be decided by the Tribunal expeditiously. (P.C.Verma,J.)
