Mr. Chandramauli Shah, Advocate for the petitioner. Mr. Virendra Singh Rawat, Advocate for the respondent no.1. Heard. The petitioner claims that the name of his father and mother needs correction in the school records. Hence the petition. Learned counsel for the petitioner would submit that the name of the father of the petitioner is Rameshwar alias Ramesh Kumar, and the name of the mother of the petitioner is Bhu Devi alias Rani. Now, the petitioner wants the name corrected so as to reveal his father’s name as Rameshwar and mother’s name as Bhu Devi. He would also submit petitioner had made representation to the respondent no.2, the Principal, Sarswati Vidya Mandir, Kichha, Udham Singh Nagar, but no action has been taken on it; the matter may be decided in view of the law laid down by the Hon’ble Supreme Court in the case of Jigya Yadav through her father Vs. CBSE, (2021) 7 SCC 535. Learned counsel for the respondent no.1 would submit that if the petitioner fresh representation, enclosing gives a therewith all respondent nos.2 and 3, the respondent nos. 2 and 3 representation and documents respondent no.1, and the decision may be only taken in view of the judgment of the forward the documents Hon’ble Supreme Court in the case of Jigya Yadav (supra). He would also submit that finally the respondent nos. 2 and 3 shall forward the representation within a week, and within the next three weeks, the respondent no.1 may take a decision on it. The Court statement given by learned counsel for the respondent no.1. takes on record The writ petition is disposed of with the liberty to the petitioner to make a representation to the respondent nos. 2 and 3, enclosing therewith all the documents. The respondent nos. 2 and 3 are further directed representation/documents respondent no.1 within next one week. The respondent no.1 shall, thereafter, take a decision on such representation within a period of three weeks in view of the law, as laid down by the Hon’ble Supreme Court in the case of Jigya Yadav (supra). forward (Ravindra Maithani J.)
