’HON BLE MR.JUSTICE PREM SHANKER ASOPA Mr.Vijay Pathak, for the petitioner BY THE COURT Heard learned counsel for the petitioner. In this writ petition, the petitioner has made the following prayer:
(i) Issue a writ order or direction in the nature thereof thereby quash and set aside the charge sheet served u/r 16(2) of CCA rules vide dated 15-06-2010 to the petitioner. (ii) Issue a writ order or direction in the nature thereof thereby the respondents be directed to provide all documents which the petitioner required for his defence. (iii) Issue any other writ order or direction, which this Hon'ble Court deems fit and proper, may kindly be passed in favour of the petitioner. (iv) Cost of the writ petition be also awarded in favour of the petitioner.
At the outset, counsel for the petitioner has pressed only Prayer No.(ii) with regard to providing the documents required by him for his 2 defence in respect of which, the petitioner has already filed an application on 25.8.2010 (Anx.10) before the Disciplinary Authority and demanded twenty one documents. The charge against the petitioner is relating to filing of the forged Transfer Certificate No.1037 of Government Secondary School, Jhareda (Hindaun) whereas on enquiry, it was found that at the aforesaid serial No.1037 the name of Kailash Singh Jat son of Ramoli Jat was mentioned. In my opinion, the aforesaid document is one of the relevant documents, therefore, the respondents are directed to give photo stat copy of the aforesaid document to the petitioner. As regards other documents demanded by the petitioner, relevancy of the same will be decided by the Disciplinary Authority and the Disciplinary Authority is directed to pass appropriate order on the application dated
