In the aforesaid writ petitions, the impugned order is dated

23.12.2010 and December 24th was the last working day of the year 2010 and after the winter break was over, on the next date of the reopening of the courts i.e. 4.1.2011 the aforesaid two writ petitions have been filed. (3) On 7.1.2011, the notices were ordered to be issued to the respondents and since then, the reply has been filed only by the 3 University of Rajasthan in both the writ petitions but no reply has been filed either by the State or the NCTE or the Coordinator, PTET Cell, J.N. Vyas University, Jodhpur despite grant of further time on

21.1.2011 to file reply/additional affidavit by 24.1.2011 as the writ petitions were likely to be rendered infructuous on account of efflux of time. (4) Application No.3602 dated 22.1.2011 filed by the petitioner for taking additional documents on record, is allowed. (5) It is stated in the writ petition that the petitioners are the recognised institutions and that the delay in holding the first and the second counselling is on the part of the State Government without any fault of the petitioner institutions and thereafter, it was decided on 27.10.2010 not to hold the third counselling. It is further stated that the petitioner Institutions filed writ petition against the said decision dated 27.10.2010 and this Court on

14.12.2010 in KMD Memorial College of Education & Others V. State of Rajasthan and others (CWP No.15131/2010 and other connected ten writ petitions) directed to reconsider the matter in regard to third counselling for admission to B.Ed. Course looking to the fact that 12,000 and more seats were vacant in the Institutions and it was expected that the respondent State Government will take sympathetic view keeping in mind that the petitioner institutions are having their infrastructure and staff as per the intake capacity granted by the NCTE and the observations were made that in past the Institutions were permitted to work on Sundays and to take extra classes to complete the requirement of 200 teaching days with 6 hours a day. This Court at the principal seat at Jodhpur, on 22.12.2010 in Jagrati Sansthan Society V. State 4 of Rajasthan and others (CWP No.11056/2010 and other connected eight cases) while placing reliance on the judgment dated

14.12.2010 in KMD Memorial College of Education & others V. State of Rajasthan and others (CWP No.15131/2010 and other connected ten writ pettions) annulled the order of the State Government dated 27.10.2010 and directed the respondents to take decision by tomorrow i.e. 23.12.2010 with the definite expectation to take into consideration the order dated 14.12.2010 and Bright Future Teacher Training and others. (6) The respondent University has filed reply to the writ petition. It is stated in para 3 of the preliminary objections of the reply that the course of B.Ed. has already been started and the examination of B.Ed. is going to commence in the month of September, 2011. Counsel for the University has further drawn attention to para 6 of the preliminary objections wherein reference has been given to the comparative calendar between the existing and newly admitted students which was produced by the counsel for the petitioner and copy of the same was given to the counsel for the respondents.

(7) The case was heard on 21.1.2011 and a detailed order was passed and considering urgency, an opportunity was granted to the State of Rajasthan and the NCTE to file reply and additional affidavit by 24.1.2011 but neither reply nor additional affidavit has been filed by the State of Rajasthan or the NCTE. (8) Counsel for the petitioner reiterates his arguments recorded in the order sheet dated 21.1.2011 which is as follows: “Heard learned counsel for the parties. Counsel for the petitioner inter alia submits that the order of the State Government dated 23.12.2010 is contrary to the observations/directions issued by this Court in its judgment dated 14.12.2010 in KMD 5 Memorial College of Education and others V. The State of Rajasthan and others (CWP No.15131/2010 and other connected writ petitions), and the judgment dated 22.12.2010 passed at the Principal Seat of this Court in Jagrati Sansthan Society V. State of Rajasthan and others (CWP No.11056/2010 and other connected eight cases).

This Court, while passing the order dated 14.12.2010 in CWP No.15131/2010 KMD Memorial College of Education & others V. The State of Rajasthan and others (and other connected ten writ petitions) observed that in the past, the Institutions were permitted to work on Sundays and to take extra classes to complete requirement of minimum 200 working days and six hours of study in a day and that the respondent State would be free to look into all aspects for taking a proper view to reconsider the matter in regard to the third round of counselling for admission to B.Ed. Course looking to 12,000 and more vacant seats in the Institutions. At page 6 of the judgment in KMD Memorial College of Education & others V. The State of Rajasthan and others (supra), this Court observed as under: “It is, made clear that observations of minimum 200 classes in academic session and six hours per day classes would not be ignored by the State Government and, accordingly, take a proper view in consonance to the provision of law.

In the past institutions were permitted to work on Sundays and to take extra classes to complete requirement of minimum 200 working days and six hours of study in a day. Respondent State would be free to look into all aspects for taking a proper view.” (emphasis supplied) This Court, while deciding similar controversy in Jagrati Sansthan Society V. State of Rajasthan and others (CWP No.11056/2010 and other connected eight cases) at the Principal Seat at Jodhpur, on 22.12.2010 anulled the decision of the State Government dated 27.10.2010 and it was expected to take decision as assured to the Court latest by tomorrow keeping in view the observations made therein and the decisions referred. The relevant observations of the Court are as under: “The learned counsel appearing for the petitioners submit that while taking such decisions, the Government is required to take note of the decision of this Court in the case of Bright Future Teacher Training Vs.State 2009(2) RLW 1197.

It is definitely expected of the State Government to reconsider the mater with reference to the observations already made by this Court in the 6 aforesaid order dated 14.12.2010 and so also the above referred decision in Bright Future Teacher Training's case. In view of the aforesaid the impugned order as issued by the State Government on 27.10.2010 is required to be and is hereby annulled. The State Government is expected to take decision as assured before this Court latest by tomorrow keeping in view the observations made herein and the decisions referred hereinabove. These writ petitions are allowed to the extent indicated above. No costs.” (emphasis supplied) Further submission of counsel for the petitioner is that the State has not considered the past practice of the Institutions to take extra classes on Sundays to complete the present requirement of minimum 200 working days and 6 hours of study in a day and further submitted that this Court in Bright Future Training V. State, reported in 2009(2) RLW 1197 = 2009(2) WLC (Raj.) 365 has considered this aspect of the matter of taking extra classes on Sundays and other holidays which may be counted as working days with respect to the then requirement of 180 teaching days.

Relevant sub para (v) of para 30 of the aforesaid judgment is as under:

(v) In the present cases, 180 teaching days can be completed for the academic session 2008-2009 by holding extra classes on holidays, over time classes on working days by counting one teaching day as two teaching days or by shortening the summer vacations in order to ensure the examinations to be held immediately thereafter, which is the past practice of the University also to meet ut such contingency.

Counsel also submits that it appears that the State while passing the impugned order dated 23.12.2010 has neither consulted the N.C.T.E. nor the University nor considered the calendar of the University for holding the examination of B.Ed. according to which the examination is to be held in the month of September, 2011 as well as earlier judgment of this Court in Bright Future Teacher Training & Ors. V. State of Rajasthan and others 2009 (2) RLW 1197 = 2009(2) WLC (Raj.) 365, subsequently referred in the judgment dated 22.12.2010 in Jagrati Sansthan Society V. State of Rajasthan and others (CWP No.11056/2010 and other connected eight cases).

Although the State of Rajasthan and the National Council for Teacher Education has been served but no reply has been filed by the State and 7 the N.C.T.E. However, respondent No.3 University of Rajasthan has filed reply and in para 3 it has been mentioned that the course of B.Ed. has already been started and the examination of B.Ed. is going to commence in the month of September, 2011. Counsel for the University in para 6 of the preliminary objections has given reference to the comparative calendar between the existing and newly admitted students which was produced by the counsel for the petitioner and copy of the same was given to the counsel for the respondents. Considering the urgency of the matter, the respondents State of Rajasthan and the N.C.T.E. are at liberty to file reply/additional affidavit by 24.1.2011. With the consent of counsel for the parties, the case is fixed for final disposal on 25.1.2011 with CWP No.87/2011, CCP No.50/2011 and CCP No.51/2011.

(9) Counsel for the petitioner summed up his submissions that the third counselling earlier denied vide order dated 27.10.2010 was annulled by the Principal Seat of this Court at Jodhpur in Jagrati Sansthan Society V. State of Rajasthan and others (CWP No.11056/2010 and other connected eight cases) vide its judgment dated 22.12.2010 and the time was granted to reconsider the matter and take decision by tomorrow i.e.

23.12.2010 and it was definitely expected of the State Government to reconsider the matter with reference to the observations already made by the Court in the aforesaid order dated 14.12.2010 in KMD Memorial College of Education & Others V. The State of Rajasthan and others ( CWP No.15131/2010 and other connected ten writ petitions) and also referred in the judgment in Bright Future Teacher Training & Ors. V. State of Rajasthan and others 2009(2) RLW 1197 = 2009(2) WLC (Raj.) 365. But the order of the State Government dated 23.12.2010 wherein reasons have been recorded from Point No.1 to 5 is not in accordance with the aforesaid judgments of this Court as well as the scheme of the examination and record. 8 (10) Counsel for the Co-ordinator, PTET submits that they started process of counselling as per the directions of the State Government and the On-line process of counselling can be completed within a week and the candidate in such a situation can be allowed further one week's time to report to the Institution.

(11) Counsel for the State has orally submitted that the order dated 23.12.2010 is neither contrary to the scheme of examination nor contrary to the judgments passed by this Court and the same is just, legal and proper. (12) Counsel for the NCTE has insisted only on completion of 200 working days exclusive of the period of examination and admission and further submitted that the Institution shall work for a minimum of thirty six hours in a week (five or six days) as per the Norms and Standards in Appendix-4 of the National Council for Teacher Education (Recognition Norms & Procedure) Regulations, 2009. Counsel also submits that it was the duty of the State Government to complete the third counselling in time so that the aforesaid requirement is fulfilled and the intake capacity allotted by the NCTE is filled up. (13) It is submitted by the counsel for the University that the course of B.Ed. has already been started and the examination of B.Ed. is going to commence in the month of September, 2011.

Counsel for the University has further given reference to the comparative calendar between the existing and newly admitted students which was produced by the counsel for the petitioner. (14) I have gone through record of the writ petitions, contempt petitions and further considered the aforesaid submission of counsel for the parties. 9 (15) Before proceeding further, it is necessary to quote the order dated 23.12.2010. The same is as under: Order dated 23.12.2010 राजःथान सरकार िश(cid:162)ा (मुप-1) (cid:466)वभाग बमांक: प.10( 3) िश(cid:162)ा 1/09 जयपुर, (cid:465)दनांक 23.12.2010 आदेश रा(cid:207)य के बी.एङ महा(cid:466)व(cid:429)ालय(cid:585) म(cid:581) ूवेश हेतु ूथम काउ(cid:219)सिलंग माह अगःत 2010 एवं (cid:465)(cid:430)तीय काउ(cid:219)सिलंग अ(cid:200)टबरू 2010 म(cid:581) आयो(cid:468)जत क(cid:551) जाकर 77051 अ(cid:223)यिथ(cid:91)य(cid:585) को ूवेश (cid:465)दया जा चुका है। इसके प(cid:433)ात भी सीटे (cid:464)र(cid:416) रहने पर संःथाओं (cid:430)ारा तृतीय काउ(cid:219)सिलंग करवाने के अनुरोध पर (cid:466)वचार कर रा(cid:207)य सरकार (cid:430)ारा तृतीय काउ(cid:219)सिलंग नह(cid:547)ं करने का िनण(cid:91)य िलया गया (cid:468)जसे (cid:466)विभ(cid:219)न संःथाओं (cid:430)ारा उ(cid:205)च (cid:219)यायालय जयपुर एंव जोधपुर पीठ म(cid:581) चुनौती द(cid:547) गई। उपरो(cid:416) यािचकाओं म(cid:581) माननीय उ(cid:205)च (cid:219)यायालय जयपुर (cid:430)ारा एसबी िस(cid:466)वल (cid:464)रट यािचका 16123/2010 बाबा गंगानाथ ट(cid:547)ट(cid:547) कालेज बनाम सरकार व अ(cid:219)य (10 अ(cid:219)य यािचकाएं) म(cid:581) पा(cid:464)रत िनण(cid:91)य (cid:465)दनांक 14.12.10 एवं माननीय उ(cid:205)च (cid:219)यायालय, जोधपुर (cid:430)ारा एसबी िस(cid:466)वल (cid:464)रट यािचका 11056/2010 जामित संःथान सोसायट(cid:547) बनाम सरकार व अ(cid:219)य (08 अ(cid:219)य यािचकाएं) म(cid:581) पा(cid:464)रत िनण(cid:91)य (cid:465)दनांक 22.12.10 म(cid:581) यािचकाओ को िनःता(cid:464)रत करते हए रा(cid:207)य सरकार को िनद(cid:566)श (cid:465)दये है (cid:465)क बीएड ूिश(cid:162)ण हेतु तृतीय काउ(cid:219)सिलंग के िनण(cid:91)य पर रा(cid:207)य सरकार पुन(cid:91)(cid:466)वचार करे। पुन(cid:91)(cid:466)वचार करते समय बीएड ूिश(cid:162)ण हेतु जो 12000 सीटे (cid:464)र(cid:416) रह गई इस त(cid:216)य को (cid:218)यान म(cid:581) रखा जाए, साथ ह(cid:547) एनसीट(cid:547)ई (cid:430)ारा िनधा(cid:91)(cid:464)रत गाईडलाईन के आधार पर शै(cid:162)(cid:468)णक सऽ म(cid:581) िनधा(cid:91)(cid:464)रत 200 क(cid:162)ाएं 6 घ(cid:214)टे ूित(cid:465)दन के (cid:465)हसाब से पूर(cid:547) हो, इस त(cid:216)य को भी (cid:466)वचार म(cid:581) रखा जाए। संःथाओं के संसाधन(cid:585) एवं उनक(cid:551) एनसीट(cid:547)ई (cid:430)ारा िनधा(cid:91)(cid:464)रत सीट(cid:585) पर ूिश(cid:162)ण करवाने क(cid:551) ःवीकृ ित के त(cid:216)य पर भी (cid:466)वचार (cid:465)कया जाए एवं समम (cid:468)ःथित पर (cid:466)वचार करते हएु समुिचत िनण(cid:91)य िलया जावे। माननीय उ(cid:205)च (cid:219)यायालय ने रा(cid:207)य सरकार को बीएड ूिश(cid:162)ण हेतु तृतीय काउ(cid:219)सिलंग के िलए एनसीट(cid:547)ई के नामस(cid:91) के आधार पर एवं (cid:464)र(cid:416) रह(cid:547) सीट(cid:585) को (cid:218)यान म(cid:581) हए पुन(cid:466)व(cid:91)चार कर समुिचत िनण(cid:91)य के िनद(cid:566)श ूदान (cid:465)कये है। माननीय उ(cid:205)च (cid:219)यायालय (cid:430)ारा उपरो(cid:416)ानुसार पा(cid:464)रत िनण(cid:91)य ु ु 10 के बम म(cid:581) रा(cid:207)य सरकार (cid:430)ारा बीएड पाठयबम 2010 क(cid:551) तृतीय काउ(cid:219)सिलंग करवाने के संबंध म(cid:581) िन(cid:224)न (cid:466)ब(cid:219)दओं को (cid:218)यान म(cid:581) रखते हए पुन(cid:466)व(cid:91)चार (cid:465)कया :-

बीएड पाठयबम म(cid:581) ूवेश हेतु ूथम काउ(cid:219)सिलंग का काय(cid:91) पूण(cid:91) से कर करते हए बीएड पाठयबम का सऽार(cid:224)भ माह अगःत (cid:465)दया गया है। ूथम काउ(cid:219)सिलंग प(cid:433)ात बीएड महा(cid:466)व(cid:429)ालय(cid:585) को म(cid:581) (cid:464)र(cid:416) रह(cid:547) सीट(cid:585) को म(cid:218)यनजर रखते हए (cid:465)दनांक (cid:465)(cid:430)तीय चरण क(cid:551) काउ(cid:219)सिलंग का पंजीकरण शु(cid:227)क जमा कराने क(cid:551) अ(cid:468)(cid:219)तम ितिथ िनधा(cid:91)(cid:464)रत करने का िनण(cid:91)य िलया।

य(cid:465)द तृतीय काउ(cid:219)सिलंग क(cid:551) जाती है तो एनसीट(cid:547)ई (cid:430)ारा घ(cid:219)टे ूित(cid:465)दन क(cid:162)ाए ) के (cid:465)हसाब से पूित(cid:91) नह(cid:547)ं हो जो सकती है। ूितशत कोस(cid:91) पूण(cid:91) हो , य(cid:465)द ऐसी (cid:468)ःथित म(cid:581) और अ(cid:223)यिथ(cid:91)य(cid:585) को ूवेश (cid:465)दया चुका है जाता है तो न तो िनधा(cid:91)(cid:464)रत मानद(cid:214)डानुसार वाःत(cid:466)वक काय(cid:91)(cid:465)दवस(cid:585) क(cid:551) पूित(cid:91) होगी एवं न ह(cid:547) ऐसे अ(cid:223)यिथ(cid:91)य(cid:585) क(cid:551) उ(cid:416) पाठयबम म(cid:581) िनधा(cid:91)(cid:464)रत गुणव(cid:419)ा आवेगी। 6 50

य(cid:465)द वत(cid:91)मान म(cid:581) रा(cid:207)य सरकार तृतीय काउ(cid:219)सिलंग क(cid:551) अनुमित ूदान करती है तो यो(cid:202)य अ(cid:223)यिथ(cid:91)यां को ूवेिशत होने म(cid:581) लगभग कम से कम 1 माह का समय िन(cid:468)(cid:433)त (cid:510)प से लगेगा।

रा(cid:207)य म(cid:581) ःथा(cid:466)पत (cid:466)व(cid:435)(cid:466)व(cid:429)ालय(cid:585) (cid:430)ारा िश(cid:162)क ूिश(cid:162)ण पाठयबम(cid:585) क(cid:551) वा(cid:466)ष(cid:91)क प(cid:464)र(cid:162)ाएं माह अूेल से जून के ूथम स(cid:431)ाह म(cid:581) ूार(cid:224)भ होती है। इस ितिथ से पूव(cid:91) तृतीय काउ(cid:219)सिलंग करने पर एनसीट(cid:547)ई (cid:430)ारा िनधा(cid:91)(cid:464)रत काय(cid:91) (cid:465)दवस पूण(cid:91) नह(cid:547)ं हो सकते। अत बीएड क(cid:551) (cid:464)र(cid:416) रह(cid:547) संभा(cid:466)वत काउ(cid:219)सिलंग नह(cid:547)ं कराये जाने का िनण(cid:91)य िलया गया है। : उपरो(cid:416) समःत प(cid:464)र(cid:468)ःथितय(cid:585) को म(cid:218)यनजर रखते हएु सीट(cid:585) हेतु तृतीय 13500 (emphasis supplied) ह./- ूमुख शासन सिचव संकु ल एवं संःकृ त िश(cid:162)ा ूितिल(cid:466)प िन(cid:224)निल(cid:468)खत को सूचनाथ(cid:91) एवं आवँयक काय(cid:91)वाह(cid:547) हेतु ूे(cid:466)षत है:-

5. संबंिधत संःथाए ह./- शासन उप सिचव ू ु ु ु 11 ूथम ” (16) The relevant portion of the earlier judgment in Bright Future Teacher Training & others (supra), K.M.D. Memorial College of Education and others (supra) and Jagrati Sansthan Society (supra) have already been reproduced hereinabove. (17) On consideration of the aforesaid judgments, reply of the University of Rajasthan and the order of the State Government (Anx.2) it is clear that the State Government has passed the order dated 23.12.2010 without consulting the NCTE and the University of Rajasthan and further not acted in consonance with the earlier judgments of this Court and the same is also not in accordance with the scheme of examination as pointed out by the University, while deciding Points No.1,2,3,4 and 5 which are as follows: (18) Point No.1. Time was available with the State Government to hold the third counselling on 1.11.2010 but the same was not held and no justification was given in the earlier writ petitions therefore, the Court has directed to reconsider the matter in the light of Bright Future Teacher Training & Ors.

V.State of Rajasthan and others (supra) and past practice. No justification has been given in these writ petitions, either in writing or orally, for not holding the third counselling in time, therefore, the fault lies with the State Government, for which the Institution/students cannot be allowed to suffer. (19) Point No.2 – As regards finding of not completing 200 teaching days 5-6 hours per day (actual working days) the State Government has not considered the earlier judgments in Bright Future Teacher Training & Ors. V.State of Rajasthan and others 12 (supra) regarding which definite expectation was expressed by this Court in Jagrati Sansthan Society V. State of Rajasthan and others (supra) wherein neither the NCTE nor the University has objected for holding the extra classes on Sundays and other holidays. Otherwise also, there is a restriction of minimum 36 hours in a week (five or six days) but further, there is no restriction in NCTE Regulations for not holding extra classes on Sundays and other holidays.

(20) Point No.3 The Students from second counselling were admitted on 23.10.2010 and as per the Institutions, the students have reported on or about 1.11.2010. In case the actual working days from 1.11.2010 is counted, then up to 23.12.2010 the same are 40 days (actual working days), therefore, the reason of completion of 50% course out of 200 working days is incorrect. (21) Point No.4 Otherwise also, the State Government was at fault in not holding third counselling after holding second counselling on

14.10.2010, therefore, the said period can be shortened by holding On-line counselling. (22) Point No.5 The State Government without consulting the University which in its reply has submitted that the B.Ed. Examinations would commence in the month of September, 2011 when the students admitted in the second counselling on or about

1.11.2010 in order to complete 200 actual working days with 5 or 6 hours a day in a week and considered the fact that the examination will be held from April to June. The State Government was not even aware of the fact that the examination would be conducted in the month of September, 2011 and has taken into consideration the month of April and June, 2011 for examination and in case all 13 holidays from February, 2011 to September, 2011 are converted into working days, the students now allotted by third counselling will be completing 200 actual working days in the month of September, 2011. Similar direction was issued in Bright Future Teacher Training & Ors. V. State of Rajasthan and others (2009 (2) RLW 1197 = 2009(2) WLC (Raj.) 365 and implemented by the State Government and it was definitely expected of the State Government to consider the observations made in the order dated

14.12.2010 and also the Bright Future Teacher Training V. State (supra), in Jagrati Sansthan Society V. State of Rajasthan and others (CWP No.11056/2010 and other connected eight cases, decided on 22.12.2010, but the same was not kept in view by the State Government. (23) In view of the above, the order dated 23.12.2010 is not in consonance with the judgment of this Court dated 14.12.2010 in KMD Memorial College of Education and others V.The State of Rajasthan and others (CWP No.15131/2010 and other connected ten writ petitions) and subsequent judgment dated 22.12.2010 in Jagrati Sansthan Society V.State of Rajasthan and others (CWP No.11056/2010 and other connected eight cases wherein definite expectation was expressed by this Court to consider the Bright Future Teacher Training & Ors. V.State of Rajathan and others (2009(2) RLW 1197 = 2009(2) WLC (Raj.) 365 and order dated

Operative part

14.12.2010, reproduced hereinabove, were given. (24) Accordingly, both the writ petitions are partly allowed, the order dated 23.12.2010 is quashed and set aside and the respondent State Government is directed to consider the judgment of this Court in Bright Future Teacher Training & Ors. V.State of 14 Rajathan and others (2009(2) RLW 1197 = 2009(2) WLC (Raj.) 365, KMD Memorial College of Education and others V.The State of Rajasthan and others (CWP No.15131/2010 decided on 14.12.2010 and other connected ten writ petitions) and Jagrati Sansthan Society V.State of Rajasthan and others (CWP No.11056/2010 and other connected eight cases, decided on 22.12.2010 at the Principal Seat of this Court) and to pass appropriate fresh order in consonance with the aforesaid judgments in the matter of holding third counselling within this week.
