HON'BLE MR.JUSTICE GOPAL KRISHAN VYAS Mr.R.S.Saluja for the petitioner/s. Mr.Rajkumar Mehta for the respondent/s. Mr.Arjun Singh, Dy.G.A. In this case it is prayed by the petitioner that in the seniority list issued by the respondents for the post of Supervisor Grade -I in the work charge cadre his name is shown at Sl.No.71 and his date of appointment is shown as

01.12.1971 whereas the name of Mohan Singh is appearing at Sl.No.77, therefore, Mohan Singh is much junior than him because he was appointed on 01st of July 1984. Mohan Singh was granted benefit of promotion on the post of Supervisor in pursuance of award passed by Labour Court, Bikaner. The petitioner is claiming promotion on the ground that his junior Mohan Singh has been promoted by the respondents while ignoring the seniority. Upon perusal of seniority list , the petitioner's claim for promotion is well founded because admittedly Mohan Singh is junior than the petitioner in the cadre of Work Supervisor Grade -I, which is feeder post provided for the post of Supervisor and Mohan Singh was promoted on the post of Supervisor. In view of the above facts, I deem it just and proper to grant an opportunity to the petitioner to file representation to the respondents apprising all these facts to the respondents. Upon filing the said representation within a period of one month from today, the respondents shall consider the case of the petitioner for promotion and if petitioner is otherwise eligible for promotion and junior person Mohan Singh was promoted earlier, then the petitioner shall be given the benefit of promotion from the date of promotion of Mohan Singh on the post of Supervisor, within a period of two months from the date of filing of the representation.
