HON'BLE MR. JUSTICE GOPAL KRISHAN VYAS Mr.I.R. Choudhary, for the petitioner. Heard learned counsel for the petitioner. In this case, petitioner is claiming appointment on the basis of qualification acquired by him from B.N. Mandal University, Madhepure, Bihar. In reply to writ petition filed by the respondents, it is specifically stated that petitioner has passed B.Ed. examination from B.N. Mandal University, Madhepure, Bihar through R.A. College of Education and upon inquiry it has been found that the college was not in existence. In such circumstances, it is a case of fraudulence, hence, the petitioner is not entitled to any relief under Article 226 of the Constitution of India. 2 Accordingly, while accepting the preliminary objection, this writ petition is dismissed.
