#1. The petition under Section 528 Bharatiya Nagrik Suraksha Sanhita, 2023, seeks the following reliefs:- (i) Direction to official respondents No.3 and 4 not to unnecessarily harass the petitioner on account of false and frivolous complaints filed by respondents No.5 to 8. (ii) Direction to official respondent No.3 not to proceed further with the complaint filed by respondents No.5 to 8 against the petitioner. (iii) Direction to official respondents No.2 to 4 to take strict action against respondents No.5 to 8 for filing false, frivolous complaints, harassing and humiliating the petitioner and to protect life and liberty of the petitioner.
#2. Learned counsel for the petitioner submits that petitioner’s father, who died on 01.09.2018, was running business firm in the name and CRM-M-36589-2026 (O&M) -2- style of Sharma Trading Company. After his death, the firm was closed. On
31.03.2025, respondents No.5 to 7 along with their 10-12 associates formed an unlawful assembly outside petitioner’s house, armed with deadly weapons. They demanded Rs.20 lacs and extended threats to the life and liberty of the petitioner and his family members. In this regard, petitioner filed a complaint to Commissioner of Police, Jalandhar but no action was taken. Learned counsel further submits that respondent No.8 had sent a video message to the petitioner on his whatsapp number extending threats and demanding Rs.20 lacs. Against the unlawful acts, petitioner filed a civil suit which was pending. Now, respondent No.8, in connivance with respondents No.5 to 7 had filed a complaint against petitioner and his brother regarding cheating and petitioner was being illegally called to the office of respondent No.3 and being pressurized to pay up Rs.20 lacs. Learned counsel for the petitioner further submits that his petition be treated as his representation.
#4. Notice of motion to official respondents. Mr. Kunwarbir Singh, AAG Punjab, accepts notice on behalf of official respondents. On instructions from SI Jasdeep Singh, he submits that a complaint against the petitioner was filed by private respondents, on which inquiry was going on. Representation of the petitioner was also received on
12.03.2026 which is also pending and process in both representations was underway.
#5. In view of response of learned State counsel, let, representation filed by the petitioner and complaint filed by the opposite side be decided within a period of 3 months from today. Thereafter, appropriate action be taken, as per law. Petitioner would however, be required to visit the police CRM-M-36589-2026 (O&M) -3- station in connection with inquiry as and when called by the police.
