Apprehending danger to their life and liberty, both the petitioners have filed the present petition with a prayer to direct the official respondents to protect their life and liberty from the hands of respondent Nos.4 to 9 as they are living in live-in relationship.
Learned counsel for the petitioners submits that both the petitioners are major. Petitioner No.1 is stated to be major being born in the year 1990. Date of birth of petitioner No.2 is 19.07.2004. Copies of their Aadhar Cards have been annexed as Annexures P-1 and P-2, respectively. Learned counsel further submits that both the petitioners were earlier married. It is stated that husband of petitioner No.2, namely Sandeep Singh, passed away on 10.02.2026 and that two children born out of the said wedlock are presently residing with petitioner No.2. As regards petitioner No.1, it is submitted that he was married to Manjit Kaur, however, the parties separated in the year 2022 through a Panchayati divorce. It is further stated that no child was born out of the said marriage. It is further submitted that both the petitioners are known to each other and have developed an emotional bond with each other and have started living together, i.e. they are in live-in relationship.
Learned counsel for the petitioners has also referred to a judgment of co-ordinate Bench of this Court passed in CRWP No.5898 of 2023 titled as CRWP-7289-2026 2 ‘Saranjeet Kaur and another Versus The State of Punjab and others’, decided on
13.06.2023, wherein protection in such a situation was granted to both the petitioners who are living in live-in relationship.
In so far the present petition is concerned, learned counsel for the petitioners has limited their prayer to direct the official respondents to decide representation dated 11.06.2026 annexed as Annexure P-3 moved by the petitioners.
Notice of motion. On the asking of the Court, Mr. Gautam Thapar, Sr. DAG, Punjab accepts notice on behalf of respondent Nos.1 to 3 and has no objection in deciding the representation filed on behalf of the petitioners.
Without commenting upon the merits of the case and in view of the limited prayer made by learned counsel for the petitioners, the present petition is disposed of with a direction to respondent No.2 to decide the representation dated
11.06.2026 annexed as Annexure P-3 within a period of two weeks. In case, it is found that there is a genuine threat to the lives and liberty of the petitioners, then necessary steps warranted under law be taken at the earliest, so as to ensure that no harm is caused to the petitioners.
However, this direction will not validate the live-in status between the petitioners and will have no effect on any civil or criminal action, which would be initiated in the matter in accordance with law.
