Operative part

CORAM: HON'BLE MR. JUSTICE M.M. AGGARWAL Present:- Mr. G.C. Dhuriwala, Advocate for the petitioner. Mr. J.S. Cooner, Advocate for respondent Nos. 1 to 4. Mr. Deepak Sabherwal, Advocate for respondent No.6. M.M. AGGARWAL, J. (ORAL) This is a petition against the order dated 15.06.2006 of Motor Accident Claims Tribunal, Ambala whereby request of present petitioner for re-calling the conditional warrants of arrest was declined. On behalf of the petitioner, it is argued that petitioner-owner of the offending truck has already paid Rs.2,25,000/- towards satisfaction of the awarded amount. He is even ready to hand over the offending truck bearing No. HR 37A/3195 for sale for payment towards remaining decretal amount. Civil Revision No. 3415 of 2006 --2-- Under these circumstances, it is directed that the petitioner shall present himself in question before M.A.C.T.Ambala/Executing Court on 11.05.2007 and M.A.C.T. Ambala / Executing Court may take custody of the truck in question and then take steps to put that truck to auction and realize whatever amount is possible by auction. That amount be paid to the decree holder/claimants and thereafter M.A.C.T., Ambala will re-hear the petitioner as far as his objections are concerned. Meanwhile conditional warrants of arrest shall not be executed. This petition is disposed of in view of the aforesaid terms. April 16, 2007 Dinesh ( M.M. AGGARWAL ) JUDGE
