9.12.2008 registered at Police Station Sadar, Patiala, under Sections 420, 406, 120-B IPC. It is not in dispute that the petitioner has been declared proclaimed offender in the afore-said FIR. The petitioner, on the other hand, relies upon some subsequent enquiry conducted by the police authorities in which the petitioner is said to have been found innocent. In my considered view, no pre-arrest bail can be granted to a person who has been declared proclaimed offender, unless a very strong case of initiation of fraudulent proceedings is made out. Dismissed. Crl. Misc. No.M-14580 of 2011 [2] The petitioner, if so advised, may surrender before the trial court and thereafter seek his release on regular bail. If any such application is made by him, the trial court is directed to consider and dispose of the same within a period of three days especially keeping in view the subsequent enquiry report and the petitioner's allegation that the FIR is a counter-blast.
