Heard Sri Pankaj Dheer Singh Rana, learned counsel for the petitioners, Smt. Ranjana Srivastava, learned AGA for the State and perused the record.

No one has appeared on behalf of the private opposite party.

By means of order dated 29.11.2024, the matter was sent to the mediation and conciliation centre, the order reads as under: "1. Heard learned counsel for the petitioners, learned A.G.A. for the State and Sri Niyaj Ahmad, Advocate, who has filed his Power today on behalf of opposite party no.4, which is taken on record.

2. By means of this petition, petitioners have assailed the F.I.R. dated 12.09.2024 registered as F.I.R./Case Crime No.0195 of 2024 under Sections 406, 420, 504 and 506 I.P.C. at Police Station Summonpur, District Ambedkar Nagar.

3. Learned counsel for the petitioners and learned counsel for opposite party no.4 state that there is strong possibility of settlement between the parties, therefore, parties may be sent to the Mediation and Conciliation Centre of this Court for settlement of their dispute amicably through mediation. Further submission is that the petitioners have already deposited an amount of Rs.1,35,000/- before the Senior Registrar to show their bonafide for mediation.

Accordingly, the matter is referred to the Mediation and Conciliation Centre of this Court. Let the parties appear before the Mediation and Conciliation Centre of this Court on 04.12.2024. The Mediation Centre shall conclude the mediation proceedings within a period of six weeks and submit its report before this Court.

List this case in the second week of January, 2025.

Till the next date of listing, the petitioners shall not be arrested in the aforesaid F.I.R./Case Crime number, subject to full cooperation in the investigation of the case. "

4. In compliance of the order of this Court, a demand draft of Rs.1,35,000/- has been 2 CRLP No. 8658 of 2024 deposited before the Senior Registrar of this Court as original tender challan has been enclosed with the order sheet.

5. Learned counsel for the petitioners has stated that the parties appeared before the mediation and conciliation centre where mediation could not be successful. The mediation report dated 26.06.2025 is on record which says that "Mediation completed. No agreement. ".

6. Learned counsel for the petitioners has also informed that the charge-sheet has been filed in the present case, therefore, this writ petition has become the demand draft of infructuous. However, he has requested Rs.1,35,000/- may be returned to him.

Since, the mediation could not be successful and chargesheet has been filed, therefore, this petition has been rendered infructuous. Accordingly, the same is consigned to the record.

However, the petitioners may file appropriate application before the Senior Registrar of this Court getting back the demand draft of Rs.1,35,000/- , which has been deposited in compliance of the order of this Court and the same may be returned to him as per law.
