Ray, ASC CORAM: JUSTICE DIXIT KRISHNA SHRIPAD ORDER 23.09.2025 The short grievance of the petitioners is as to non- consideration of his representation dated 30.08.2024, a copy whereof avails at Annexure-6, wherein they have sought for release of the arrears of salary that has accrued due during the period between 01.03.1988 and 31.05.1994.
Learned counsel appearing for the petitioners submits the similarly circumstanced other employees the said benefit has been extended as per Annexures-4 & 5, whereas a step-motherly attitude is shown to his clients and therefore, this Court should intervene in the matter.
Learned AGA appearing for the OPs vehemently opposes the petition saying that the Court should not come to the aid of sleepy and tardy, said Jeremy Bentham. He also tells that the Writ Jurisdiction cannot be tapped after long delay, obviously evidentiary material not being available for decades. Having so contended, now, he agrees to instruct OP No.2 to look into the grievance of the petitioners keeping in view all contentions that are taken up in the petition and that may be available to the officials as well. In the above circumstances, Writ Petition disposed off. Time for compliance is eight (8) weeks, which would include communicating the decision taken on the subject representation to the petitioner. All contentions are kept open. It is open to the answering opposite parties to solicit any information or documents from the side of the petitioner, as required for taking a decision on the subject representation. However, in that guise delay shall not be brooked. Now, no costs. Web copy of order to be acted upon by all concerned.
