This matter is taken up through hybrid arrangement.
In filing the present Writ Petition, the Petitioner alleged to be an encroacher has challenged the order of the appellate authority dated
24.06.2026 passed Encroachment Appeal Case No.09 of 2015 vide Annexure-9. Apart from the above, the Petitioner has also challenged the order of eviction issued vide letter No.8683/Enc. dated 18.07.2026 vide Annexure-11.
Heard learned counsel for the Parties.
During course of hearing, learned counsel for the Petitioner submits that though the Petitioner has already challenged the order of the appellate authority impugned herein by preferring a revision vide Revision Case No.10 of 2026, during pendency of the said revision at the instance of the Petitioner the authority concerned has issued the impugned notice of eviction dated 18.07.2026.
In such view of the matter, though this Court is not inclined to entertain the prayer made in this Writ Petition, since the above noted revision at the instance of the Petitioner is still pending, this Court directs the concerned revisional authority to take up the revision at the instance of the Petitioner within fifteen working days from the date of presentation of an authenticated copy of this order and try to conclude the said proceeding as early as possible in accordance with law.
It is further directed that till the revisional authority take up the revision petition at the instance of the Petitioner filed challenging the order dated 24.06.2026 passed in the above noted Encroachment Appeal, no coercive action shall be taken against the Petitioner pursuant to the impugned order of eviction vide letter No.8683/Enc. dated 18.07.2026 vide Annexure-11 so also the dispute involved in this matter.
This Writ Petition is, accordingly, disposed of.
