Heard learned counsel for the Petitioner and learned counsel for the State.
The Petitioner is seeking pre-arrest bail in connection with G.R. Case No.1291 of 2025 pending on the file of learned JMFC, Rajgangpur, arising out of Bargaon P.S. Case No.342 of 2025 for commission of offences punishable Sections 303(2)/317(2)/61(2)(a)/3(5) of BNS, 2023 r/w section 11 of Prevention of Cruelty to Animals Act, 1960 r/w section 7 of Orissa Prevention of Cows Slaughter Act, 1960.
Learned counsel for the State opposes the prayer for pre-arrest bail.
Taking into account the nature of allegations, it is directed that on surrendering within three weeks hence and moving for bail, the Petitioner shall be released on bail by the learned Court in seisin on such terms as deemed just and proper subject to verification of criminal antecedent of similar nature.
If it comes to fore that the Petitioner has any such criminal antecedent, this order shall not be given effect to.
It is further stated that the Petitioner shall cooperate with the ongoing investigation.
