CORAM: HON’BLE MR. JUSTICE RAJESH SHANKAR For the Petitioner For the State : Mr. Rahul Kumar, Advocate : Mr. P.D. Agrawal, Spl.P.P. Order No. 04 Dated: 16.07.2024 The petitioner apprehending his arrest for the offences punishable under Section 414/34 of the Indian Penal Code and Section 11(1)(a)(d)(e) of the Prevention of Cruelty to Animals Act, 1960, has prayed for grant of anticipatory bail.
Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and has not committed any offence as alleged in the F.I.R. The petitioner is the owner of the pickup van bearing registration no. JH-04Y-6567 in which seven bovine animals were allegedly found loaded. So far as co-accused Md. Sami Akhtar Ansari @ Sami Akhtar- the purchaser of the said bovine animals is concerned, he has already been granted anticipatory bail by the Sessions Judge, Dumka vide order dated
22.05.2024 passed in A.B.P. No. 189 of 2024. The petitioner undertakes to cooperate in the ongoing investigation. Hence, he may be given the privilege of anticipatory bail.
Learned Spl.P.P. opposes the petitioner’s prayer for anticipatory bail.
Having heard learned counsel for the parties and on consideration of the materials available on record, I am inclined to enlarge the petitioner on anticipatory bail. 1 5 Accordingly, the petitioner, above named, in the event of his arrest or surrender before the court below within three weeks from today, shall be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Dumka in connection with Shikaripara P.S. Case No. 95 of 2023, subject to the conditions as laid down under Section 438(2) Cr.P.C. Ritesh/ (Rajesh Shankar, J.) 2
