of 2017 arising out of Thakurgarh P.S. Case No. 48 of 2016 under Section 394 of I.P.C. pending in the Court of the learned Additional Sessions Judge, Athamallik.
The Petitioner was granted bail on 20.12.2016. However, the Petitioner did not appear before the Court below on 22.11.2023 leading to issuance of NBW against him.
Learned counsel for the Petitioner on instruction from his client undertakes that his client would be appearing before the Court below on or before 29th February, 2024 and seeks appropriate remedy available to him under law.
Taking into consideration the above facts and submission at the Bar, the order dated 22.11.2023 passed by the learned Additional Sessions Judge, Athamallik in C.T(s) Case No.02 of 2017 is set aside, subject to the Petitioner paying cost of Rs.500/- to be deposited in the Orissa High Court Advocates’ Welfare Fund.
