B E F O R E HON’BLE MR. JUSTICE AHANTHEM BIMOL SINGH 22-02-2024 Heard Mr. Th. Tolpishak, learned counsel appearing for the petitioners and Mr. H. Samarjit, learned GA appearing for respondent Nos. 1 to 5. None appeared for respondent Nos. 6 & 7 despite service of notice. The present writ petition has been filed with a simple prayer for directing the respondent No. 5, i.e. the Assistant Survey & Settlement Officer –VII, Thoubal to issue a memorandum of demarcation, which was held on 18-12-2019 in connection with the Demarcation Case No. 30/AS&SO-Tbl-VII within a fix period. In view of the limited prayer made in the present writ petition, this Court passed an order on 18-12-2023 directing the said AS&SO-(VII)/Thoubal to furnish a report as to the reason why the said memorandum of the demarcation held on 18-12-2019 in connection with the aforesaid demarcation case was not issued. Pursuant to the aforesaid direction given by this Court, the learned Government Advocate placed before this Court a letter dated 31- 01-2024 from the Assistant Survey & Settlement officer-X stating inter alia 1 that the said AS&SO is not in a position to issue the said memorandum of demarcation as the earlier AS&SO who carried out the demarcation has Item No. 19 retired from service. Mr. H. Samarjit, learned GA appearing for the official respondents submitted that the present writ petition can be disposed of by directing the concerned AS&SO to complete the demarcation process within a period of 2(two) months from today. Mr. Th. Tolpishak, learned counsel appearing the for petitioners fairly submitted that the present writ petition can be disposed of as prayed for by the learned GA. In view of the submission made by the learned counsel appearing for the parties, the present writ petition is disposed of by directing the AS& SO-Tbl-VII or any officer presently holding the said post to complete the aforesaid demarcation process and to issue the memorandum as early as possible but not later than 2(two) months from JUDGE today.
