C.K.ABDUL REHIM, J.----------------------------------------W.P.(C) No. 25652 OF 2012-----------------------------------------------Dated this the 1st day of November, 2012JUDGMENTMain relief sought for in this writ petition is for a directionto the respondents to review Ext.P4 order and to treat thebroken period of service as commuted leave, instead of earnedleave. Ext.P4 is a proceedings issued by the 2nd respondentwherein the disciplinary action initiated against the petitionerwas concluded. With respect to the period of unauthorisedabsence, findings in Ext.P4 is to consider the same as earnedleave. According to the petitioner, against Ext.P4 decision hehad submitted Ext.P8 representation before the 1st respondent. But I take note of the fact that Ext.P4 is a proceedings issuedwhile finalising the disciplinary action initiated against thepetitioner. If the petitioner is in any manner aggrieved by Ext.P4, he has to seek remedy of appeal before the appropriateauthority under the relevant Service Rules. It is not proper forthis Court to direct the 1st respondent to consider Ext.P8 which issubmitted without resorting to the appellate remedy. W.P.(C) No. 25652 OF 2012 :2:2.
