Writ Appeal No.1063 of 2012....................................................................Dated this the 3rd day of July, 2012.JUDGMENTRamachandran Nair, J.Heard counsel for the appellants and Standing Counsel forKSEB. Even though appellants' prayer is for shifting of the electricline to the other side of the road, KSEB opposed stating that the same isnot technically possible and the 11 KV line will have to cross the roadwhich they have to avoid as far as possible. Further, it is also statedthat support poles will have to be installed and if line is shifted, it willcertainly lead to objection from other private land owners. As such theline is passing only through the road and appellants' grievance is thatcertain coconut trees slanting into the road over the line will have to becut down. We feel appellants will have to be given adequatecompensation for the coconut trees cut as it is loss of regular income. We dismiss the Writ Appeal with the specific finding that appellants WA 1063/20122are entitled to compensation for the coconut trees cut from theirproperty.
