It is not in dispute that the respondent completed several works for appellant Corporation and out of several bills, four bills are pending to be paid. According to learned counselfor appellant/Corporation, part of the above four bills which iscovered by maintenance grant has already been paid and the remaining payment for the above four bills can be paid only from the own funds of the Corporation on the basis of seniority. Therefore there is no possibility of meeting the pending bills of the respondent/Contractor until further grants are received sofar as portion of the amounts covered by own funds is already paid and the amount due to the respondent/Contractor is only with regard to the amounts to be received by way of grant. According to him, Corporation sincerely opines that on or before W.A.No.1577/2012231/03/2012, they would be able to clear the dues of therespondent/Contractor once the grants are received. Recording these submissions of learned senior counsel for appellant, we dispose of the appeal granting time to the appellant for making payment till 31/03/2013.
