Judgment
B.A. No. 7097 /2010-:2:-surrender before the investigating officer on 30.12.2010 or on31.12.2010 for the purpose of interrogation and recovery ofincriminating material, if any. In case the investigating officeris of the view that having regard to the facts of the case arrestof the petitioner is imperative he shall record his reasons forthe arrest in the case-diary as insisted in paragraph 129 ofSiddharam Satlingappa Mhetre's case (supra). Thepetitioner shall thereafter be produced before the Magistrate orthe Court concerned and permitted to file an application forregular bail. In case the interrogation of the petitioner iswithout arresting him, the petitioner shall thereafter appearbefore the Magistrate or the Court concerned and apply forregular bail. The Magistrate or the Court on being satisfied thatthe petitioner has been interrogated by the police shall, afterhearing the prosecution as well, consider and dispose of hisapplication for regular bail preferably on the same dateon which it is filed. 4.In case the petitioner while surrendering beforethe Investigating Officer has deprived the investigatingofficer sufficient time for interrogation, the officer shall B.A. No. 7097 /2010-:3:-complete the interrogation even if it is beyond the time limitfixed as above and submit a report to that effect to theMagistrate or the Court concerned. Likewise, the Magistrate orthe Court also will not be bound by the time limit fixed asabove if sufficient time was not available after the productionor appearance of the petitioner.
